How is child support calculated if I have children from previous relationships that I have a duty to support?

The court will determine the obligor’s net resources as outlined above; however, the court will assign a different percentage to be paid towards the child support to be paid.  For example, if an obligor had 1 child with one mother who was seeking support and was paying support for 1 child from a previous relationship, the percentage owed to the mother seeking support would be 17.50 % instead of 20%.  Thus an obligor whose monthly net resources are $1,000 should pay $175 in child support.

Please note that the percentage would only apply to the child who is the subject of the child support lawsuit that you are currently involved with.  If you wanted to modify the child support of a prior order based upon an obligation to support a new child, the obligor would need to seek modification of the earlier child support order.

Is there a cap on the amount of net resources that can be considered when ordering child support?

There is a presumptive cap that states that maximum amount of net resources that can be considered is $7,500.
